Can Calling Your Husband Impotent Amount To Cruelty? Delhi High Court
A man was granted a divorce by the Delhi High Court (HC) due to his wife’s mental cruelty. A wife publicly humiliating her husband by calling him impotent and talking about their sexual issues in front of family members might be grounds for divorce, according to the Delhi HC Bench consisting of Justices Suresh Kumar Kait and Neena Bansal Krishna.
The statement was made by the court during the hearing of the husband’s appeal against a Family court ruling that denied him a divorce.
The wife must respect her Husband’s Privacy
The woman is expected to be more careful and to preserve her husband’s privacy, according to the Delhi HC.
The court stated that such revelations, even to family members, are a source of humiliation. The wife became irate and fled to her parental house after two unsuccessful IVF treatments, the court observed.
Divorce Due to Childlessness
The appeal explains that while the couple was married in the year, 2011, they were unable to conceive naturally, and had to use In Vitro Fertilisation (IVF) treatment.
They went through this IVF process twice but still were not able to have children.
The husband Was Proven Medically Fit
The husband claimed that his wife had medical issues, but instead, he suffered public humiliation. His wife placed him responsible for not their childlessness.
The wife allegedly called him impotent in front of her parents and other family members, which the husband claimed was a sheer insult.
Case Filed as Evidence of Dowry Abuse
The court further stated that although the wife had asserted, the Court overturned the order passed by the Family Court. The court granted divorce to the appellant as per the Hindu Marriage Act, 1955.
It further stated, “We are compelled to conclude that the appellant had been subjected to cruelty on the appreciation of the entire evidence as led by the parties.”
