Can I Change My Lawyer? What If My Lawyer Refuses To Give Me The NOC?

Yes, you can change your lawyer in-between a case that is ongoing in a court in India.

Firstly, it’s your fundamental right to choose and appoint a lawyer of your choice.

To change your present lawyer it’s important for you to obtain the consent and a No Objection Certificate (NOC) on the vakalatnama by your present advocate.

But What If My Present Lawyer Does Not Cooperate To Give Me The Consent Or NOC?

In such a scenario you can approach the court in which your case is under trial and file an affidavit in the court to obtain the permission to change your present advocate.

The court generally grants you the permission to change your present lawyer by directing you to ensure that all your payment dues/ any remaining payments of the lawyer’s professional fees are cleared with your present advocate.

What If My Present Lawyer Is Unnecessarily Delaying To Give An NOC? 

In such a case your new lawyer must simply file his/her vakalatnama in the court where your case is pending. After the new vakalatnama is filed by the new lawyer the previous lawyer automatically gets removed for your case from the date on which your new lawyer filed his/her vakalatnama.
