Intellectual Property Rights (IPR), is an international issue which is responsible for the creation of adversarial issues between India and US in relation to IPR and Patent law enforcement. It also includes New Delhi’s decision to cap prices of medical devices. These issues are prevailing since the visit of Prime Minister Narendra Modi’s to Washington dc.

As reported by an official, “IPR has been flagged as the biggest concern that the US has with India during the trade policy review and during the visit. The biggest stumbling block is its enforcement.”

In a recent review of the India’s Trade policy by US trade authorities, issues in relation to IPR and patents was brought up and was intensified at the level of senior officials of Trump administration during Modi’s visit to US.

India has been knocked on its IPR and patent enforcement several times by US and this issue is one of the topmost priority of the Trump government and is being blended with the issue of the big ticket investment.

The divergence that prevails between IPR policy of the two sides is that the US considers IPR from commercial point of view, whereas India sees it as a development measure. During delegation level talks, India clearly stated that all the mandatory steps are being taken for the enforcement of law relating to IPR.

PRICE CAP RANKLE:

Recently Delhi government has taken steps to impose price cap on medicines and medical devices which are a subject of disappointment to the US. Also, the US government had made complaints in regard to the uncontrolled patent violations and deficiencies in the effective implementation of laws.

In regard to the aforesaid complaints, a letter was sent to the president Donald Trump by US congressional trade leaders, just a day before Modi landed in the US.

So it is critical to continue to keep the high level dialogues open between India and US so that they can render concrete reforms that will assist in resolving roadblocks and promoting sustainable economic growth.
