Law Minister Says Dozens Of Instant Triple Talaq Cases Registered Since SC Judgement

Nearly 100 cases of instant triple talaq have been registered so far in the country since the Supreme Court ruling that termed it as unconstitutional, according to the Union minister of law and justice Ravi Shankar Prasad.

The Minister was speaking in the Lok Sabha while introducing the bill to ban the practice.

A Supreme Court constitution bench comprising five justices had ruled that the practice of instant triple talaq was unconstitutional in August this year .

The list of cases registered so far that allegedly involve triple talaq are:

  • A resident of Rampur’s Azimnagar stated that on December 28 she was given triple talaq since she woke up late in the morning.
  • On December 27, a resident of Hyderabad’s Old City 31-year old Ghousia Begum, was given triple talaq by her husband Zahran Hamed Al Rajhi, who lives in Oman, over the phone.
  • A woman in Lucknow, alleged that she was given triple talaq via a phone call by her husband. The woman stated that she had wanted to continue her studies after getting married at an young age. However her husband objected to it and threw her out of the house after which he allegedly divorced her using the triple talaq on phone.
  • On December 22, a young woman from Bulandshahr district of UP was allegedly gang-raped by three men one of whom was her husband, who also divorced her via triple talaq within a week of their marriage.
  • A woman alleged on December 11 that her husband had given triple talaq to her and then eloped with her sister since her parents count not fulfil dowry demands.
  • On December 10, a woman in Bareilly alleged that her husband gave her instant divorce using triple talaq after she attended Prime Minister Narendra Modi’s rally. The woman said that she attended the rally to thank PM Modi for bringing in the legislation banning instant triple talaq. However her husband had claimed that he had divorced her due to her extramarital affair.
  • A real-estate agent was booked in Hyderabad on November 21, for allegedly divorcing his wife by uttering ‘talaq’ three times over the phone.
  • A 27-year-old beautician was allegedly given instant divorce in Hyderabad in November over the phone just 25 days after her marriage
  • Yasmeen Khalid, the wife of Aligarh Muslim University professor Khalid Bin Yusuf Khan, has alleged that her husband divorced her first via WhatsApp and then through a text message . The woman threatened to commit suicide along with her children before the AMU’s vice chancellor’s house.
  • An NRI husband divorced his wife by taking an advertisement in the newspaper. The Hyderabad Police has registered a case against the qazi who had advised the husband to use triple talaq.
  • On September 23, a young woman and mother of a three-year-old child, lodged a complaint with the Rajkot Mahila police station alleging that her husband had given her divorce using triple talaq and had thrown her out of the house 18 months ago.
