INDIA – National Minimum Wage Law: 1 in 3 Employees Unprotected In India, Says Survey Report

Economic Survey 2018-19 said Thursday (July 4 2019), proposing minimum wages to all employees/workers in the nation, one in every three employees in India are not protected under the national minimum wage law. A well-designed minimum wage scheme has been said to be a powerful instrument to protect employees and alleviate poverty. Minimum wages can be registered based on either the skills or the geographic region or both basis, he said. The survey suggested an easy and enforceable minimum wage scheme that would use technology and a toll-free number to register grievances for failure to pay statutory minimum wages. It said that under the Ministry of Labour and Employment there should be ‘national level dashboard’ for periodic minimum wage notifications.

 

INDIA – Economic Survey Mentions The Labour Reform Of Rajasthan As An Ideal Model For Boosting Employment, Productivity

The Economic Survey 2019 on Thursday (July 4 2019) highlighted the need for flexibility in labour laws, mentioning the Rajasthan model of labour reforms to increase jobs and productivity in the plant. Taking 2014-15 as the base year when labour reforms picked up in Rajasthan, the Economic Survey said the state performed much better than the rest of India in terms of factory production, growth in the number of big factories and job creation. “Studies have shown that, on average, plants in labour-intensive sectors and states that have moved to more flexible labour markets, such as Uttar Pradesh or Gujarat, are 25.4% more productive than their counterparts in countries such as West Bengal or Chhattisgarh that continue to have labour rigidity,” said the Economic Survey.

 

UNITED KINGDOM – Lawyer Who Abused The Flight Crew Racially Discovered Dead After Release From Prison

A human rights lawyer was discovered dead days after being released from prison for racist violence at Air India employees, police said. Simone Burns, 50, from Hove, was sentenced in April to six months in prison for shooting at Air India employees during last year’s flight from Mumbai to London. She was denied more alcohol and asked to talk with the pilot. Burns was filmed saying she was a “fucking international attorney” to a crew member and calling stewards “Indian money-grabbing cunts.” In the bathrooms, she also supposedly attempted to smoke a cigarette. A Sussex police spokesperson said: “A woman’s body discovered at Beachy Head, Eastbourne, on June 01, was recognized as Hove’s 50-year-old Simone Burns. Death is not regarded as suspicious and has been reported to the next of kin. The matter was passed on to the office of the East Sussex coroner.

 

INDIA – Code of Comunidade To Be Amended In The Coming Monsoon Assembly; Revenue Minister

In the upcoming Monsoon Assembly meeting, revenue minister Rohan Khaunte said on Wednesday (July 03 2019), the revenue department will amend the Comunidade Code to tackle the irregularities that occur on Comunidade land. Khaunte said the amendment was intended to strengthen the ability of the government to manage the Comunidade land of Goa and to streamline the functioning of the Comunidade bodies. The commission was formed in the direction of the high court by the BJP government following a petition by Celistinho Noronha regarding the functioning of Comunidades administration. Khaunte came up with the Idea of amending the Comunidade Code in May 2018.

 

INDIA – Allahabad HC Judge Rangnath, Who Wrote About Nepotism To PM Modi, Denied The Usual Farewell Party

Justice Rangnath Pandey, High Court (HC) Allahabad judge Rangnath Pandey who wrote a letter to Prime Minister Narendra Modi alleging favouritism, nepotism, and casteism in the appointment of judges, was not provided the usual farewell party when he retired on Thursday (July 04, 2019). The farewell party, known in the legal language as complete court reference, which was scheduled to be held at 3.45 p.m. in the Court of the Chief Justice. Due to unforeseen conditions, it was cancelled at the last minute. In a letter, the registrar informed the cancellation. The development was not commented on by any of the judges.

 

USA – Homicide Charge Dropped Against Alabama Woman Who Was Shot While She Was Pregnant

Prosecutors in Alabama said on Wednesday (July 3, 2019), in a case that stirred national outrage, they dropped a homicide charge against a woman for the death of the fetus she was carrying when she was shot in the belly. The woman, Marshae Jones, was charged with beating up a coworker who eventually drew a weapon and shot it, hitting Ms Jones in the stomach and killing her fetus, who was five months old. A grand jury in Jefferson County, convened by District Attorney Lynneice Washington, rejected charges against the colleague, claiming that she had acted in self-defence. However, she accused Ms Jones of “beginning a battle, knowing that she was pregnant for five months.”

 

INDIA – There Can Be No Pleadings In Hindi; Delhi HC Upholds Rule Compelling Pleadings To Be Filed In English

The Delhi High Court (HC) upheld the validity of the Delhi High Court Rule mandating pleadings in the English language to be filed before it. In a petition seeking a declaration that the Delhi High Court Rules are ultra vires the Delhi Official Languages Act, 2003, the judgment was passed by a Division Bench of Justice GS Sistani and Jyoti Singh to the extent that they allow only “English” as the language in which the pleadings can be brought before the High Court. Furthermore, the petition sought a direction to allow pleadings/petitionsns to be filed in Hindi. The petitioner, senior citizen DK Chopra, had submitted the request in the Hindi language in the Court Registry. Petitioner asserted that the Registry refused to recognize the petition on the ground that Hindi was not the High Court’s official language.

 

INDIA – E-pharmacies Argue To Be Like Swiggy, Supplying Drugs Only, In Delhi HC

On July 4, E-pharmacies informed the Delhi High Court (HC) that they did not require a permit to sell drugs and prescription medicines online because they did not sell them, but instead only delivered medicines similar to Swiggy’s food delivery app, informed the Chief Justice D N Patel and Justice C Hari Shankar bench. During the hearing of the plea seeking contempt action against e-pharmacies, the request went for continuing to sell medicines online despite a high court order that remained such activity. The petition also seeks consideration for the central government for supposedly taking no action against the default e-pharmacies. The PIL said that since there was no mechanism to regulate the internet sale of drugs, this puts people’s health and lives at great danger and impacts their right to a secure and healthy life according to Article 21 of the Constitution.

The Bombay High Court (HC) refused to quash proceedings against a 45-year-old Goregaon, Mumbai entrepreneur and argued that the only way to find out if accusations of fraud and sexual assault against him were true is through a court where all the material collected during the inquiry could be examined. Justice SS Shinde was hearing a criminal writ petition lodged by the complainant’s accused Vishal Singh who attempted to quash charges pursuant to Sections 376 and 420 of the Indian Penal Code. According to the petitioner, FIR was lodged for an offence under Section 420 but there was no mention of the allegation of sexual assault, and it was only in the complainant’s supplementary statement recorded on April 8, 2013, that allegations were made against the petitioner that under the pretext and promise to marry her, and he extracted enormous amounts from the complainant and exploited her sexually.”During the course of the trial, the multiple arguments raised by the petitioner in his defence must be regarded and, while exercising written jurisdiction, it is not appropriate to enter into the practice of appreciation of the prosecutor’s statements, as well as other content gathered during the inquiry and drawing of inferences,” Said the court. The petition for writing has been rejected.

 

INDIA – Madras HC Orders The Government Of Tamil Nadu Acquired Land As Illegal

The Madras High Court (HC) has proclaimed an amendment to the Land Acquisition Act of the Center produced by the Tamil Nadu government as “illegal,” exempting three state laws from its jurisdiction. It also made it clear that all property purchases produced on or after September 27, 2013, by the state government under the Three (3) state laws were “illegal.” However, a division bench of Justices S Manikumar and Subramonium Prasad, who rejected the amendment on Wednesday, ruled that the land obtained and already used for the purpose for which it was acquired before September 2013 should not be disturbed.

On Wednesday (July 3, 2019), a panel appointed by the Bombay high court voiced disappointment at the bad survival rate of trees removed and transplanted for the construction of the Cuffe Parade-Andhe Seepz Metro 3. It also said that Mumbai Metro Rail Corporation (MMRC) had no required transplant knowledge from its specialists.” Substantial numbers of trees are dead. The judges then questioned the duo about their transplantation knowledge. “It doesn’t seem like you (MMRC) have an individual with experience in this sector,” Justice said. The committee said it is possible to appoint skilled people and tiny businesses even if they have completed small-scale transplantation.
