INDIA – Cabinet To Consider Law Seeking Ban On E-Cigarettes And Also Decide Jail Term For Violators

The cabinet is probable to consider an order to prohibit the manufacturing, import, distribution, and sale of electronic cigarettes, as well as a prison term for violators, sources said on Tuesday (September 17, 2019). A group of ministers (GoM) lately reviewed the Prohibition of E-cigarettes Ordinance, 2019, following instructions from the Office of the Prime Minister. The Health Ministry proposed a maximum jail term of up to one year in the draft ordinance along with a punishment of Rs 1 lakh for first-time violators. The ministry has proposed up to three years in prison and a Rs 5 lakh penalty for repeat perpetrators, the sources said.

INDIA – Delhi High Court Prevents Delhi School From Expelling 10 EWS Students

The Delhi High Court on Wednesday (September 18, 2019)restrained Air Force Bal Bharti School to remove the names of 10 class IX EWS students for non-payment of school fees and other charges. Justice Rajiv Shakdher handed down an interim order on a plea from the 10 students, saying that the school was reportedly forcing them either to pay the charges or to take a transfer certificate. The court sought the reaction of the school and the Delhi Government to the petition and scheduled it for hearing on 7 February next year. In the petition submitted by the lawyer Ashok Agarwal, the students stated that the school threatened to expel them for non-payment of school fees and other fees, whereas they were Legally allowed to proceed their studies beyond Class VIII and Class XII. in the economically weaker class (EWS) category.

INDIA – Under The Recently Amended Law, NIA Records Its First Human Trafficking Case

Under the recently amended NIA Act, the National Investigation Agency (NIA) recorded its first case related to human trafficking. The case was registered on Tuesday (September 17, 2019) under the Indian Penal Code (IPC) and Sections 3, 4, and 5 of the Immoral Traffic Prevention Act, 1986. The case is about arresting three accused—Mohd. Yousuf Khan, Bithi Begum and Sojib, a West Bengal native but presently residing in Hyderabad. Chatrinaka Police Station made the arrests on April 21 for their involvement in the illegal trafficking and sexual exploitation of Bangladeshi females to Hyderabad. The police group saved five such females from the spot. This case was transferred from Hyderabad’s Central Crime Station on August 9.

USA – Change in Texas Sexual Assault Laws Benefits Victims Seeking Justice, Improves Tracking Of Cases

Several new Texas law to protect victims of sexual assault came into effect on September 1, which health suppliers and victim advocates said will benefit victims and enhance how law enforcement authorities monitor cases of sexual assault. For example, House Bill 3809 has doubled the time that child survivors of sexual assault can report assaults against them. Previously 15 years, victims now have 30 years to report to their abusers after their 18th birthday. Besides, institutions that protect the perpetrator may also be held responsible. Other times, kids do not report cases of abuse because they do not want to interrupt their household, especially if the abuser is a relative or family member, Harry stated.

GERMANY- Germany Supports Draft Law To Safeguard Drivers Of Parcel Delivery

On Wednesday (September 18, 2019), the German cabinet passed a draft law to force logistics and e-commerce companies outsourcing deliveries to ensure their drivers ‘ adequate social safety contributions are paid by their subcontractors. The legislation was recommended after nationwide raids on subcontracting shipping companies were initiated by police in February, and numerous instances of social security fraud and drivers working off the books were uncovered. “Sub-sub contractors work in many areas. Wages are pushed down and contributions to social insurance are not made, and we are no longer going to put up with this,” Labor Minister Hubertus Heil informed journalists.

A pregnant Muslim woman and her two siblings were reportedly stripped and tortured in a police station in the Darrang district of Assam. The pregnant lady began bleeding in her stomach when Kicked by a police officer and lost her child owing to torture. The pregnant lady was admitted to a hospital after the supposed torture, where she lost the child because of miscarriage. According to reports, on September 8 night in connection with a kidnapping case, Darrang District Police picked up three sisters-Minuwara Begum, Sanuwara and Rumela from Guwahati’s Sixmile region and took them to the Burha police outpost. Assam Police suspended Burha Police outpost’s accused officer-in-charge and the lady constable.

The first domestic abuse commissioner for England and Wales is “relieved” by the Prime Minister, who has promised to reintroduce a new law on the matter. Nicole Jacobs informed the BBC that she expects the Domestic Violence Bill to be included in the new Queen’s Speech when Parliament returns. “I understand they’re all going to watch and listen to see it in there,” she said. Speaking of concern about the fate of the Domestic Violence Bill, which fell when Parliament was suspended, Ms. Jacobs, 48, said: “Everyone was (worried), and now that we have a commitment, we can be a little bit relieved.

INDIA – Article 370 Posed Hurdle In Progress In Kashmir; RS Prasad, Minister of Law

Union Law Minister Ravi Shankar Prasad said on Wednesday (September 18, 2019) that Article 370, which granted special status to Jammu and Kashmir, was a hindrance to the advancement of the valley and that its abolition would prove to be a beneficial move. Speaking at a conclave organized by Hindustan, Purvodaya, held in Ranchi, Jharkhand, Prasad said that the Article never served any purpose for the improvement of Kashmir, but was often misused to block several governments acts. He said that, under Article 370, several acts such as the Right to Education, the Right to Information and the Prevention of Corruption Act could not be implemented in the former Indian state. He said that Kashmir is an indispensable part of the territory of India and that the government will always work to improve the Union territory.

INDIA – Government Constitutes Company Law Panel To Improve The Ease Of Doing Business

The Government decided on Wednesday to set up an 11-member panel to propose steps to de-clog and enhance the functioning of the NCLT and to make suggestions on multiple problems related to the application of the Companies Act and the Limited Liability Partnership Act. The Committee, led by Corporate Affairs Secretary Injeti Srinivas, would also propose steps to remove any bottlenecks in the general functioning of statutory bodies such as the Serious Fraud Investigation Office (SFIO), (IEPFA) Investor Education and Protection Fund Authority and National Financial Reporting Authority (NFRA). The Committee would, from time to time, send its recommendations to the Government in phases and subject-matter as may be decided by the Chair. It will have a tenure of one year from the date of its first meeting.

DUBAI – A Woman Visitor Accused Of Working As A Prostitute In Dubai

A 27-year-old female on a visa visit was prosecuted by the Dubai Court of First Instance on Tuesday for engaging in prostitution. The incident was recorded at Bur Dubai Police Station on June 18, after the Russian lady claimed she had been compelled to have sex with a man. A police sergeant said that while on patrol, he was alerted to an incident by the Operations Room. “When we detained her, the lady was drunk. She said she had sex with a Turkish guy she had just encountered at a night club in his apartment. The female stated that she was compelled to have sex with a friend of his, also a Turkish. Later, she withdrew her declaration, confessing that it was both consensual. They were all accused, along with a third person, of drinking alcohol without a permit at that court.

INDIA – ONGC Fined Rs 2.05 Crore For Breach Of Green Norms In Assam

The Pollution Control Board, Assam, has imposed a fine of Rs 2.05 crore on PSU Oil and Natural Gas Corporation (ONGC) for supposedly breaking the Supreme Court’s order and causing environmental pollution. The Board’s order was issued considering the violation of environmental laws in six wells of state-owned energy behemoths in Assam. The ONGC was requested to deposit the cash within one month of the order being issued. When contacted, NGOC representatives refused to make comments instantly.

INDIA – Delhi HC is Transferring 2G Cases To The Court Hearing INX Media Cases

The High Court of Delhi transferred all cases relating to the 2G Spectrum allocation scam, pending before Special Judge O P Saini, to the trial judge who is hearing INX Media cases against former Union Minister P Chidambaram and his son Karti. As per the order of the High Court of Delhi Registrar General D K Sharma, Special Judge Ajay Kumar Kuhar will commence the trial of the 2G case on 1 October as Judge Saini retiring on 30 September. Judge Saini recently awarded anticipatory bail to Chidambaram and Karti in the cases of corruption and money laundering of Aircel-Maxis and subsequently adjourned it sine die.

Twenty months after Rajesh Maru, a 33-year-old resident of Lalbaug, lost his life after being sucked into an MRI machine at Nair Hospital, the High Court of Bombay held the hospital accountable for negligence on Tuesday (September 18, 2019). The court also ordered compensation to the Maru family for Rs 10 lakh. INDIA – HC Bombay Refuses To Give Relief To A Guy With Hyperhidrosis Seeking An RBI Job

In a setback to the hyperhidrosis applicant (excessive sweating) who was denied a job with the Reserve Bank of India (RBI) because his fingerprints were a mismatch, the High Court of Bombay (HC) dismissed his plea on Tuesday. The plea was dismissed on the ground that it failed to tell the examiner of his condition before taking the examinations in which he was successful and considered to have been qualified for the post of assistant. The Bench of Justices Akil Kureshi and S J Kathawalla, while hearing Akshay Sakpal’s petition, through the advocate Ashish Giri, said that his client had notified the examining authority of his condition prior to the examination and that, therefore, when his fingerprints were mismatch after the exam, he could not be denied jobs.

INDIA – BMC Moves The Supreme Court, Pleads Bombay HC Misinterpreted The Apex Court’s Order On Mahul Inhabitants

One day remaining for the High Court of Bombay is to issue its final order in a case regarding the rehabilitation of hundreds of inhabitants of Mahul, an area in Mumbai’s Chembur, which is often referred to as a ‘ toxic hell. ‘ However, the Brihanmumbai Municipal Corporation (BMC), which is a party to the case, passed the most significant court of the country on Tuesday. In its request to the Supreme Court, the civic body of Mumbai stated that the High Court of Bombay had misinterpreted the order of the apex court in that regard. The claim of the BMC was made concerning the order of the SC of 22 July when it disposed on the case of the civic body by saying that further clarification was not essential in this regard.
