INDIA – Lawyer Parasaran Was Given The Most Eminent Senior Citizen Award In India International Centre

Vice President Venkaiah Naidu presented the ‘ Most Eminent Senior Citizen Award ‘ to former Attorney General K Parasaran at the Indian International Center on Sunday. Parasaran was given the award on the occasion of the Elder’s Day celebration organized by Age Care India, An organization that works for the benefit of the elderly. Conveying his gratitude to Parasaran, the Vice-President said, “At 92, Parasaran stands tall across the length and breadth of India in terms of knowledge of the law, knowledge of the Shastras, erudition, and ethics, and is rightly referred to as the ‘ Pitamaha ‘ of the Indian Bar.” He said the award was a fitting acknowledgment of Parasaran’s outstanding contribution to the field of law and justice, as well as his remarkable personality, and called him “a deeply spiritual legal practitioner who has sought to combine ‘ dharma ‘ and justice.”

INDIA- Election Commission- 25.000 Of The 1 Lakh Overseas Indians Enrolled In E-Rolls Voted In The LS Polling Stations

Just a little over 25.000 of the nearly one Lakh overseas Indians who had registered as voters had returned to India to exercise their franchise in the 2019 Lok Sabha polls, according to the data released this month by the Election Commission. A total of 99,807 overseas Indians living abroad and not giving up their nationality are on the voters ‘ lists of the various states. A bill to increase the facility of proxy voting to overseas Indians lapsed with the dissolution of the 16th Lok Sabha. The Ministry of Law proposes to reintroduce the bill in Parliament pending approval by the Cabinet of the Union. As of now, overseas Indians are free to cast their votes in the constituencies in which they are registered. The bill sought to give them the option of proxy voting, which is only now available to service personnel.

The criminal law of Canada on libel — publishing a defamatory comment about someone — has come to be seen by many in the legal community as a relic, its use seems to be on the rise. And some experts warn that this may pose challenges to free expression. While most libel cases were dealt with in civil courts rather than in criminal proceedings, the allegation stayed on the books and was upheld as legal in the 1998 Supreme Court decision. She is one of the cohorts of Canadian legal experts who say the Supreme Court was wrong, arguing that the accusation is an intrusion into freedom of expression that leaves the door open to violence and needs to be repealed.

INDIA – 292 Paramilitary Personnel Such As CRPF And BSF, Have Lost Their Lives For India In The Last Year

As many as 292 police personnel, including paramilitaries such as the CRPF and BSF, have lost their lives on duty across the country between September 2018 and August of this year during anti-terror and other operations, according to official data. It also mentioned that more than 35.000 police officers had sacrificed their lives for the country from independence to August of this year. State police officers were martyred while dealing with Naxals, terrorists, liquor and sand mafias and other law and order duties, he said. The names of the 292 martyrs would be read during the Police Commemoration Day function on Monday. The day is marked by a tribute to the ten policemen killed in 1959 by the firing of Chinese troops.

INDIA – Crisis In PMC Bank: Cash Trapped For More Than A Month, Depositors Fear The Uncertain Future

Almost a month after the Reserve Bank of India (RBI) had scam-hit Punjab and Maharashtra Co-operative Bank (PMC) operations, the depositors said that their woes had only escalated, with some unable to pay school fees, while others found it difficult to meet medical expenses. Some worry that they may risk their lifetime earnings on savings accounts or in the form of fixed deposits. On 24 September, PMC Bank Managing Director Joy Thomas sent an SMS to its depositors on Reserve Bank of India imposing regulatory limits, capturing withdrawals of up to Rs 1,000 for a period of six months. Since then, Joy Thomas and the promoters of Housing Development Infrastructure Limited (HDIL) Rakesh and Sarang Wadhawan have been arrested in an alleged fraud case. Amid complaints from account holders, RBI increased the amount to Rs 10,000 and then Rs 40,000 earlier this month. The depositors, however, who have deposited lakhs or, in some cases, even crores in the bank, have said that the sum is too low to meet the monthly expenses.

IRAN – Iran Holds An Expert Conference On Unilateralism And International Law

Iran is expected to host an international conference on unilateralism and international law at the Allameh Tabataba’i University in Tehran on Monday (October 21, 2019). The conference, which is being organized by the Abrar International Research and Studies Institution and the Allameh Tabataba’i University, will be hosted by several international law experts from different countries, including Italy, India, Russia, Finland, Poland, Pakistan, Uzbekistan, Macedonia, and Afghanistan. Zarif will deliver a speech at the opening ceremony of the conference. The event will include four expert panels on various issues related to the promotion of international law and multilateralism and the fate of peace and global security.

INDIA – Banks And Creditors Poorly Served By The Code Of Bankruptcy

A single unified bankruptcy code, which was felt in 2016, will allow recovery more comfortable and liquidate companies as soon as possible. Yet, three years later, hopes have been broken. Three years later, with several amendments and informal, often conflicting messages and advice from the Government, it is clear that the functioning of the 2016 Insolvency and Bankruptcy Code (IBC) and the National Company Law Tribunal (NCLT) has been less than satisfactory. In fact, the Government said that it would be best to resolve personal and small disputes involving, say, home buyers outside the IBC and the Tribunal. While the Government boasts of repealing 2,460 antiquated laws and India jumping 30 positions in the Ease of Doing Business index, India ranked 108 out of 189 countries in the Ease of Resolving Insolvency rankings. INDIA – Next Space Rockets Of China Expected To Make Test Flights By 2020, 2021

China will launch test flights for the next two space rockets in its Smart Dragon series planned for commercial use in 2020 and 2021, a local news agency reported on Sunday that the anticipated satellite deployment boom is accelerating. The release of China Rocket Co, a state-owned China Aerospace Science and Technology Corp. flight schedule, comes two months after the company’s first reusable rocket, the 23-ton Smart Dragon-1, delivered three satellites to orbit. China envisages constellations of commercial satellites that can offer services ranging from high-speed Internet to aircraft tracking of coal shipments. Reusable designs would require regular rocket launches and help keep costs down.

INDIA – The Indian Army Attacks Pak Army Posts, Terror Launch Pads Across PoK, Kills Five Pak Soldiers

Four launch pads in the Neelam Valley (Pakistan Occupied Kashmir) have been attacked and destroyed by the Indian Army. Fatalities have also been registered on the Pakistan side. Sources report that 4-5 Pakistan’s Army soldiers were killed and several wounded. On Sunday, in response to Pakistan’s ceasefire violation to aid infiltration into Kashmir, the Indian Army launched a counterattack on terrorist camps inside Pakistan’s Occupied Kashmir (PoK) in front of the Tangdhar sector. This assault was launched after Pakistan breached a truce in the Tangdhar sector in Jammu and the Kupwara district of Kashmir earlier that day.

Stepping up efforts to tackle unfair business practices, Competition Commission Chairman Ashok Kumar Gupta said that the regulator has adopted a proactive approach in resolving cases on a suo motu basis to ensure prompt market correction. The regulator, which maintains a record of anti-competitive conduct on the marketplace has so far dealt with more than 1,000 anti-trust lawsuits across a wide range of sectors According to him, more and more competitiveness issues are likely to arise for a growing economy like India. Confirming that the Competition Commission of India (CCI) is “essentially an inquisitorial body and not an adversarial body,” Gupta observed that it has the responsibility to ensure a broad correction of the market rather than to confine itself to redressing individual grievances.

Justice is equal to people of all religions, caste, gender, and it is the duty of lawyers to uphold the fundamental rights of citizens as enshrined in the Constitution of India, said All India Lawyers Union (AILU) National President Bikash Ranjan Bhattacharya at the 11th State-level meeting of the lawyers ‘ body on Saturday. The President of the AILU said that the judiciary has a vital role to play and should be impartial. “In our country, human rights have been trampled on during the emergency. The situation is the same, even today. The Supreme Court is taking the path of caution, also as the right to speak is denied in the country, as is evident in Kashmir. “It is the duty of the judiciary to come to the aid of citizens fighting the government on unequal ground. What scares me, though, is that blackmailing tactics are being used by the arm-twist judiciary. Judges are being blackmailed into making unjust decisions, “he concluded. The meeting was attended by former MLC Prof. K Nageswar and lawyers from different States.

INDIA – Court Hits Out for Officer Comes Late For Hearing In DK Shivakumar Case, After A Junior Counsel Represented For Some Time

The Delhi High Court, on Thursday (October 17, 2019), disciplined the Enforcement Directorate after a junior lawyer had argued his case for some time due to a delay in the arrival of a senior law officer at the hearing on the request for bail of Karnataka Congress leader DK Shivakumar. “You can’t play hide and seek with the court,” Justice Suresh Kait said, adding, “This is not the way. It’s not appropriate. The court isn’t supposed to wait.”  He made these harsh remarks when the junior lawyer appearing for the Enforcement Directorate (ED) requested lodging for 30 minutes on the ground that the law officer was busy at the District Court in Rouse Avenue . Justice Kait had reserved the order for the bail petition asking the ED to file a written submission by 12 p.m. on 19 October but later allowed the Agency to initiate arguments after the arrival of additional Solicitor General KM Natraj and apologized for the delay.

Former Allahabad High Court Chief Justice and Lokpal Judicial Member Justice Dilip Bhosle said that lawyers are becoming the highest-ranking lawyers in the country as the legal profession has changed its complexion in the last five years. “There are several prominent counsels in the country filing income tax returns up to Rs 500 crore every year,” he said. He spoke after the inauguration of the two-day 22nd S C Javali Memorial National Moot Court Competition organized by Sir Siddappa Kambli University of Karnatak (KUSSK) Law College in Alur Venkatrao Bhavan, Dharwad, on Saturday (October 20, 2019).

INDIA – Lawyers Of Deity Seek Contested, Confiscated Land For ‘ Convenience Of Devotees ‘ In Ayodhya Dispute

Deity Ramlalla Virajman, one of the parties to the Ayodhya land dispute case, told the Supreme Court on Saturday that the land adjacent to the site acquired by the Center in 1993 would also be needed for the “convenience of the devotees” when the “grand temple” was built, the Indian Express reported. The Deity’s counsel argued that both the contested site and the area acquired by the government were essential to the Hindus, and requested the Supreme Court not to provide any relief to impede the project. Lawyers K Parasaran, CS Vaidyanathan and PV Yogeswaran argued that the purpose of the deity’s suit is to create a “great temple of Lord Ram” in proportion to the stature of the deity. They said that if the equity had been exercised in the case, it would have an effect on the “sacredness of the area” which also had several other sacred sites.

INDIA – Delhi HC Is Seeking AAP Government Response On Relief For Houses Damaged By Metro Construction

On Friday (October 18, 2019), the High Court of Delhi requested the response of the AAP Government and the DMRC on a plea seeking compensation for people whose homes had been damaged during the construction of the metro and the vibrations of metro trains running under their homes. Chief Justice D N Patel and Justice C Hari Shankar issued a notice to the Government of Delhi  and the Delhi Metro Rail Corporation (DMRC) seeking their position on the plea of trust which also urged the court to order the authorities to ensure the safety and security of residents of the city from the quakes of underground metro trains. The court ordered the Delhi Metro to indicate, in its response, the policy in place, if any, to compensate those affected by its construction and other operations and set out the matter for further hearing on 6 November. Directed by the bench, the petition was moved by the Anti-Corruption Council of India Trust, which claimed that the houses located above the underground metro routes had cracks in their walls and doors due to the shaking of underground train movements.

INDIA – Refund Rs 788.39 crore To Vodafone-Idea: Bombay High Court To Tax Department

The High Court of Bombay ordered the income tax department to refund Rs 788.39 crore to Vodafone Idea Ltd. (VIL) within three weeks, giving some relief to the loss-making telecommunications company, who also sought help from the government to relieve its financial stress. The refund order, more than Rs 630 crore for Vodafone India and more than Rs 150 crore for Idea Cellular, was released by the court last week. The High Court dismissed the contention that the allegations had to be re-examined merely because the telco had claimed gain in one year and lost right after that. This is the second instance that the case of a refund of tax has gone in VIL’s favor. Earlier this month, the High Court ordered the IT department to process the return of Rs 374.26 crore owing to Vodafone India.

INDIA – Madras High Court Describes The Term “Harassment” By The Police

Pointing out that the word “harassment” in itself has a very broad sense and, thus, that what could be harassment of a person may not be the same for a police officer, the High Court of Madras issued guidelines to avoid these circumstances. Justice M.S.Ramesh released the guidelines while allowing a petition from Pushparajan seeking direction from the Police Inspector, Noolambur Police Station, Chennai, not to threaten him needlessly. The judge alleged that the complainant had been abused by the Police Inspector, Noolambur Police Station, under the pretext of an investigation/enquire. An investigation of a non-cognizable crime, or a cognizable offense, was the unrestricted powers of the investigating officers, so long as the power to investigate and prosecute those offenses, were lawfully exercised within the scope of the function of Cr.P.C.

INDIA – AICC Spokesperson Alleges Scam Land Allocation In Gurgaon, Seeks For An Investigation ‘

Terminating the tenure of Manohar Lal Khattar-led BJP government in Haryana a period of bribery and scams, AICC Secretary Pawan Khera on Saturday accused CM Khattar of misusing the role while alleging fraud in the allocation of a 4,000 square foot site to Bharatiya Janata Party (BJP) in the Gurgaon Sector 30 commercial zone. Armed with documents obtained from a resident of Gurgaon, who also transferred the Punjab and Haryana High Courts, Khera said that Khattar had violated Haryana Shahri Vikas Pradhikaran (HSVP)’s rule book by assigning the site to BJP’s Gurgaon Unit for its office. He said that the land worth Rs 76 crore had been allocated to BJP against the amount of Rs 10 crore. The senior officer who had recommended against this was moved, and the responsibility was handed over to another IAS officer, who explained the decision as “a peculiar reason.” This is calling for an investigation, added Khera.
