Why Under The New Law It’s Mandatory To Register Muslim Marriage & Divorces With The Government In Assam?

The old law, the Assam Muslim Marriages And Divorce Registration Act, 1935, which required marriages and divorces to be registered through Kazis has been replaced by the new law. 

Who are Kazis? 

Kazis are Muslim scholars authorized by the state government.

Reason To Bring In The New Law?

The reason to bring in this new law is to remove the role of Kazis in Muslim marriages and divorces. So now instead of registering Muslim marriages and divorces through the kazis, the new law which is the Assam Compulsory Registration of Muslim Marriage And Divorce Bill, 2024 which aims to curb child marriages makes it mandatory to register Muslim marriages and divorces with government-appointed marriage and divorce registrars.

Main Highlights of the New Law For Registration of Muslim Marriages And Divorces- 

A NOTE- The new law in any way does not interfere with the way how Muslim marriages and divorces are conducted. It only transfers the authority of registration from Kazis to government-appointed registrars.

Main Highlights-
  • According to the new law, Muslim marriages must be registered within 30 days of marriage. 
  • Couples looking to get married can get their marriage registered under the new law.
  • Anybody who’s found to produce fake or forged certificates for marriage or divorce will be imprisoned for a term of two years and liable for a fine up to Rs.10,000 (ten thousand rupees) or both. 
  • The offenders will also be tried for forgery under the Bharatiya Nyaya Sanhita, 2023.
  • Anybody who’s found registering a Muslim marriage in violation of the provisions of the new law shall be imprisoned for a term up to one year and levied a fine of Rs. 50,000 (fifty thousand rupees).
