Sunanda Pushkar death case: Subramanian Swamy’s PIL dismissed by Delhi High Court

The Delhi High Court has dismissed Subramanian Swamy’s PIL seeking a court-monitored SIT probe into the death of Congress MP Shashi Tharoor’s wife Sunanda Pushkar, terming his PIL as a “textbook example of a political interest litigation”.

The BJP leader’s plea cannot be entertained as a PIL said the bench comprising of justices S Muralidhar and I S Mehta. The bench in the matter also stated that from what was placed before the court, it was unable to be convinced that the probe, being carried out by the SIT, is botched up or under the influence of any party.

The HC was also of the view that the information was concealed by Swamy,based on which he had made “sweeping allegations” against Shashi Tharoor and Delhi Police, as he today offered to file an affidavit revealing his source or reason based on which he had made the accusation.

“Although it has been claimed by Subramanian Swamy that he hasn’t concealed any information or data, when asked specifically on what he bases his allegations in the petition, his response was to seek time to file affidavit thereby clearly showing that what was to be disclosed at the first instance was not done,” said the Delhi High Court.

Additional Solicitor General Sanjay Jain, appearing for the Centre and the Delhi Police, during the hearing said, that they do not subscribe to the views put forth by the BJP leader that the Congress leader continues to interfere in the investigation.

The circumstances in which Pushkar was found dead were mysterious as she was found dead in a suite of a five-star hotel in Delhi on the night of January 17, 2014.
